Biography
Sergiu Gherman
Sergiu Gherman is a Miami commercial litigation attorney whose practice draws on three disciplines: law, endurance sport, and music. He represents businesses, investors, property owners, professionals, and other clients. These matters may involve contracts, fraud, financial transactions, real estate, construction, intellectual property, and related appeals. He advises on commercial agreements and transactions when careful drafting can reduce the likelihood or cost of a dispute.
His approach is practical and evidence-driven. A case begins with the governing documents, timeline, decision-makers, financial consequences, and the client’s real objective. Litigation is one tool among several. Accordingly, a well-structured demand, negotiated solution, mediation, arbitration, transaction, or targeted motion may create a better result than unnecessary conflict. When trial or appeal is required, preparation must be exacting enough to withstand scrutiny.
Commercial litigation and business counsel
Mr. Gherman has handled matters through multiple stages of litigation, including trial and appeal. His experience includes land and title disputes, fraudulent transfers, civil theft, investment and financial disputes, and commercial-loan matters. It also includes professional-malpractice and insurance issues, employment-discrimination defense, trusts and estates disputes, and attorney-fee appeals. His published case results include judgments, appellate work, settlements, possession relief, title relief, and business transactions. Past results depend on each matter’s facts and law. Therefore, they do not guarantee or predict a similar outcome in any future case.
His transactional work has included entity formation and dissolution, owner agreements, buy-sell arrangements, bylaws and resolutions, and limited-liability-company operating agreements. It has also included real-estate documents, restrictive covenants, nondisclosure and employment agreements, assignments, and loan documents. He has also prepared bilingual Romanian-English and Russian-English agreements for businesses operating across jurisdictions.
His principal practice areas are business contracts and commercial litigation, fraud, finance, and securities litigation, real estate transactions and disputes, and intellectual property, music, and sports matters.
Music, scholarship, and creative perspective
Before and alongside law, music required Mr. Gherman to listen for structure, distinguish a central theme from noise, and understand how individual parts function within a larger work. He earned a Doctor of Musical Arts degree from Temple University after studying at the Gheorghe Dima Music Academy. He has written as a music critic, including concert reviews published by The Ledger in Lakeland.
His legal scholarship includes “Harmony and Its Functionality: A Gloss on the Substantial Similarity Test in Music Copyrights.” The article appeared at 19 Fordham Intellectual Property, Media & Entertainment Law Journal 483–517 (2009). That combination of legal and musical training informs his work on music copyright, ownership, licensing, and creative-business disputes. However, it does not replace the careful factual and doctrinal analysis each matter requires.
Endurance, discipline, and perspective
Outside the office, Mr. Gherman trains for and participates in triathlon, running, and other endurance events. He has completed CLASH Daytona 70.3, CLASH Homestead-Miami 70.3, IRONMAN Haines City 70.3, the half-marathon distance at the Miami Marathon, MudRace, and other endurance events.
Endurance training has made his professional outlook more human, not less demanding. Long preparation teaches patience with incremental progress. Pacing requires attention to conditions rather than attachment to an early plan. A difficult stretch rewards composure, honest reassessment, and the ability to keep moving without confusing urgency with panic. Recovery reinforces that sustained performance depends on judgment as much as effort.
Those lessons carry naturally into legal work. Complex matters are rarely won by intensity alone. They require consistent preparation, measured decisions, resilience after setbacks, and the humility to adjust when the evidence changes. Physical activity is also widely associated with mental-health and cognitive benefits; for Mr. Gherman, the most meaningful benefit is personal: training creates perspective and restores the focus needed to serve clients thoughtfully.
Community and international service
Mr. Gherman previously served as Honorary Consul of the Republic of Moldova in Florida. His international background and multilingual work provide practical familiarity with clients and businesses that cross legal systems, languages, and cultures.
He has participated in South Florida community and professional organizations and supported local causes through service, volunteering, and charitable giving. Across his legal, musical, athletic, and community work, the common thread is preparation, clarity, and sustained commitment. He values these more than performance for its own sake.
